TERMS AND CONDITIONS – PACKAGE TRAVEL

CONTENT OF THE PACKAGE TRAVEL CONTRACT

The description of the package travel contained in the travel program or in the brochure, the booking confirmation of the services requested by the tourist, as well as the general conditions that follow, form an integral part of the travel contract. When subscribing to the tourist package sale proposal, the tourist must keep in mind that it is assumed that full the content of the travel contract has been read and accepted, including any warnings contained therein, as well as the present general conditions, for themselves as well as for the subjects for whom the all-inclusive service is required.

 

  1. LAW SOURCES

The sale of package travel including services provided both in the territory of Italy and abroad is regulated – until its repeal in accordance with art. 3 of Legislative Decree no. 79 of 23 May 2011 (the “Tourism Code”) – by Law no. 1984 of 27/12/1977, which ratifies and implements the International Convention on Travel Contracts (hereinafter: CCV), signed in Brussels on 23.4.1970, as applicable, as well as by Arts. 32-51 of the above mentioned Tourism Code as amended, and by the provisions of the Civil Code as applicable. In addition to that, sales made via the Internet are also subject to the laws on electronic commerce, that is Legislative Decree no. 70/2003. These standards are coordinated and included under consumer protection issues by the Consumer Code (Legislative Decree No. 206 of 2005, in particular Articles 45 to 58 and 63 to 67).

Where not differently indicated, the law sources to which the present Terms and Conditions – Package Travel document refers to are to be considered Italian.

 

  1. ADMINISTRATIVE REGULATION

The organizer Taste Scenario and any intermediary for the package travel, to whom the tourist turns to, are enabled to carry out their activities according to current, even regional, legislation. According to art. 18, paragraph VI of the Tourism Code, the use in the business name of the words “travel agent”, “tourism agent”, “tour operator” or other words and phrases of a similar nature, including in a foreign language, is allowed by the companies as authorized in the first paragraph.

 

  1. DEFINITIONS

For the purposes of this contract, the following definitions shall apply:

(a) travel organizer: the person or entity who commits himself/herself in their own name for a flat rate, to provide  third parties with package tours, realizing the combination of the elements referred to in art. 4, or offering to the tourist even via long-distance communication/sales systems, the ability to independently realize and buy that combination;

(b) intermediary: the person or entity who, even if not professionally and non-profit-making, sells or commits himself/herself to provide package tours under art. 4 with respect to a flat rate;

  1. c) tourist: the buyer, the beneficiary of a package tour or any person even to be appointed, provided they meet all the conditions required for the use of the service, on behalf of whom the main contractor undertakes to purchase a package tour without remuneration.

 

  1. DEFINITION OF PACKAGE (TRAVEL/TOUR, ETC.)

The definition of “package”, according to art. 34 of the Tourism Code, is the following:

“Package travel relates to travels, holidays, all-inclusive tours, cruises, resulting from the pre-arranged combination, realized by anybody and in any way, of at least two of the following components when sold or offered for sale at an inclusive price: a) transport; b) accommodation; c) other tourist services not ancillary to transport or accommodation, in accordance with Art. 36 Tourism Code, and accounting for a significant proportion of the package”. The tourist has the right to receive a copy of the travel package sales contract (drawn up in accordance with Art. 35 Tourism Code). The contract gives the right to access, if necessary, the guarantee fund according to the following art. 21.

 

  1. TOURIST INFORMATION – TECHNICAL DATA SHEET

Before the trip begins, the organizer Taste Scenario and/or the intermediary will where necessary notify the tourist of all the information deemed necessary for the trip. In addition, the organizer Taste Scenario provides a technical data sheet on the web site, in the brochure or in a program not included in the brochure – even electronically or by telematic means – whose mandatory elements are:

– details of the administrative authorization or S.C.I.A / S.U.A.P (Business commencement statement/Certificate of business commencement) of the organizer;

– details of the guarantees for travelers ex art. 50 Tourism Code;

– details of the civil liability insurance policy;

– validity period of the brochure or any program not included in the brochure;

– parameters and criteria for adjusting the travel price (Art. 39 Tourism Code).

The organizer Taste Scenario may also include additional conditions and information on the technical data sheet.

In the case of a package travel that includes transport service, upon contract conclusion, the organizer Taste Scenario shall also provide the passengers with information about the identity of the actual carrier(s), subject to the provisions of art. 11 of EC Reg. 2111/2005, and it shall also inform passengers in case the carrier(s) has/have been included on the so-called “Black list” under that same Regulation.

 

  1. PURCHASE PROPOSAL – RESERVATIONS

In the process of building and selling a tailor-made or standard package travel, reaching consensus and exchanging expressions of interest between organizer Taste Scenario and tourist may take place in two ways:

– through computerized media such as e-mail, but also forums, newsgroups, socials etc.: on the basis of requests and negotiations between the parties, a contract is drawn up via direct communication (or in the traditional way to a proposal put forward by one party an acceptance should follow by the other party – ex Article 1326 CC);

– or by accessing the user to the site of an e-shop, by subscribing to a form, that is by accepting the proposal submitted online by the system called “point & click”. In this case, an indirect communication agreement is concluded, based on the knowledge directly acquired on-line, that involves instantly the realization of consensus by electronic means.

The proposal for the package travel purchase must be written on an appropriate contractual form, if necessary electronic, that must be completed in all its parts and signed by the tourist, who will receive a copy of it.

Acceptance of the travel package purchase proposal is intended to be completed, with the consequent conclusion of the contract, only when the organizer Taste Scenario will send the relative confirmation to the tourist also by telematic means, or when necessary to the intermediary travel agent.

The information on the tourist package not contained in the contract documents, in the brochures or in other written media will be provided by the organizer Taste Scenario, in accordance with the regular fulfillment of the obligations under its own obligation under art. 37 comma 2 Cod. Tur., before the beginning of the trip. Any special requests on how to deliver and/or provide certain services that are part of the tourist package must be made when booking/at the time of request for reservation and must be subject to specific agreement between the tourist and the organizer Taste Scenario.

As an on line Travel Agency/Tour Operator, pursuant to art. 32, paragraph 2 of the Tourism Code, Taste Scenario states that, contracts stipulated either at a distance or off-premises (as defined by Article 45 of Legislative Decree 206/2005), the right to withdrawal does not apply.

 

  1. PAYMENTS

When the tourist officially commissions the organizer Taste Scenario for the organization of his/her/their travel package, a registration/administrative fee of 50 Euro (deductible from the final price of the package when eventually purchased by the tourist) will be charged to the tourist.

When accepting by subscription the purchase of the package travel proposal, a non-refundable deposit of 25% of the total price of the package must be paid. The amount of the deposit will be communicated by the organizer Taste Scenario included in the information provided to the tourist. The deposit may exceed 25% of the total price of the package should any suppliers request at the time of booking a full payment for the tourist services they will provide: in this case, the organizer Taste Scenario shall inform the tourist of this need.

The balance must be paid within the time limit set by the organizer Taste Scenario, on the basis of destinations, travel features and organizational complexity of the travel package, and anyway not later than 60 days before departure. The organizer Taste Scenario shall communicate this term to the tourist in the purchase proposal, in the confirmation of the booking of the requested package travel/service on the website or, if applicable, in the brochure.

For reservations made after the deadline set for the balance payment, if conditions to organize the travel still exist, the full amount must be paid at the time of subscription of the purchase proposal.

Failure to pay the above mentioned amounts by the due dates, by the tourist as well as by the intermediary (without prejudice to enforcement actions ex art. 50 D.Lgs. 79/2011 towards the latter) constitutes immediate cancellation clause for termination of contract by the organizer Taste Scenario and/or any intermediary agency, right to act by simple written communication, by fax or by e-mail, even at the tourist’s electronic domicile, where communicated.

Payment can be made by bank transfer, debit or credit card through the organizer Taste Scenario’s website. Payments are considered valid when the sums reach the organizer Taste Scenario directly from the tourist or from any intermediary chosen by the tourist. Where payment is made by credit card, we reserve the right to charge the tourist a transaction charge of 3% of the amount.

Security and online transaction protection on the organizer Taste Scenario’s website are guaranteed by the PayPal system.

 

  1. PRICE

The price of the tourist package is determined in the contract, with reference to the amount as indicated on-line and/or in the brochure or in the customized program and to any new price updates. Prices quoted are based on currency exchange rates valid at the time of payment. It may be varied up to 20 days prior to departure and only as a result of the variations of:

  • transportation costs, including the cost of fuel;
  • fees and taxes on certain types of tourist services such as taxes, fees or landing charges, embarkation or disembarkation at ports and airports;
  • exchange rates applied to the package in question.

For such variations, reference shall be made to the exchange rate and the costs in force at the time of acceptance of the travel purchase proposal and of booking confirmation and payment of the travel or the date of publication of the travel program, as reported in the technical file of the on-line catalog, or the date stated in any updates above mentioned.

The oscillations will affect the package price in the percentage expressly indicated in the technical file in the brochure or in the customized program not included in the brochure.

In any case, the price may not be increased within 20 days prior to departure and the revision may not exceed 10% of the original price.

The price consists of:

  1. a) registration fee or administration fee;
  2. b) entrance fee: expressed in the quotation of the package provided to the tourist or, if applicable, to the intermediary;

in addition, of any additional fees due to:

  1. c) the cost of any insurance policies to cover the risk of cancellation and/or for medical expenses or other services required;
  2. d) the cost of any visas and taxes on entry and exit from the country of destination;
  3. e) airport and/or port taxes and charges.

 

  1. AMENDMENT OR CANCELLATION OF THE PACKAGE TRAVEL BEFORE DEPARTURE

Before departure, where the organizer Taste Scenario or the intermediary needs to significantly modify one or more elements of the contract, the tourist will be notified as quickly as possible, indicating the type of change and the subsequent price variation.

If the tourist does not accept the modified proposal referred to in paragraph 1, he/she may alternatively exercise the right to be reimbursed with the sum already paid or to enjoy the offer of a replacement package travel in accordance with the second and third paragraphs of Article 10.

The tourist can exercise the above-mentioned rights even when the cancellation is due to a failure to reach the required minimum number of participants indicated in the travel program or in the brochure or for reasons of force majeure and unforeseeable circumstances related to the purchased tourist package.

For cancellations other than those caused by force majeure, by unforeseeable circumstances and by failure to reach the required minimum number of participants as well as for those other than the non-acceptance by the tourist of the alternative tourist package offered, the organizer Taste Scenario in cancelling (Art 33 and Consumer Code), will return to the tourist the price paid and monetary compensation, also if through an intermediary travel agent.

The value of such compensation will be communicated by the organizer Taste Scenario to the tourist and in any case the total amount to be refunded will never exceed twice the amount which the tourist would owe on the same date in accordance with Art. 10, fourth paragraph, if he/she were to annul the package.

 

  1. WITHDRAWAL ON THE PART OF THE TOURIST

The tourist can withdraw from the contract, without paying penalties, in the following cases: increase in the price of the package travel exceeding 10%; significant change to one or more of the elements of the contract, objectively fundamental to the tourist’s enjoyment of the package as a whole, if proposed by the organizer Taste Scenario after the subscription of the contract but before the departure and when not accepted by the tourist.

In the above cases, the tourist has the right:

– to take advantage of an alternative package travel of an equivalent or superior quality, if the organizer can propose it. If the all-inclusive service is of lower quality, the organizer must refund the difference in price to the tourist;

– to a refund of any sums already paid. Such a refund must be made within the terms of the law.

The tourist must give notice of his/her decision (to accept the change or withdraw) within the time specified by the organizer Taste Scenario starting from when the notice of the increase or change was received. In the absence of clear notice within the aforementioned term, it is understood that the proposal made by the organizer Taste Scenario is accepted.

Any traveler who withdraws from the contract before departure outside the hypotheses listed in the first paragraph will be charged, irrespective of the payment of the deposit referred to in art. 7, the administrative fees and penalties as indicated in the information given at the time in the technical sheet of the package travel or as published in the brochure or in the customized program and any payment for insurance already required at the time of contract or for other services already rendered.

In the case of pre-constituted groups, such sums will be agreed on a contractual basis at the time. No reimbursement will be granted to those who decide not to continue with their trip during the course of the tour.

From the above are excluded travels that include the use of scheduled flights or other services at special rates. In these cases, the conditions for cancellation penalties are deregulated and much more restrictive and will be communicated at the time.

For any request for modification asked by the tourist on reservations already accepted, signed in the contract and confirmed by the organizer Taste Scenario, within the limits in which it can be met and without any obligation for the organizer Taste Scenario, the organizer Taste Scenario reserves the right to apply an additional administrative charge which the tourist will be informed of when necessary. Requests for changes made by the tourist to the organizer Taste Scenario within 30 days prior to departure may be considered as a request for cancellation or withdrawal from the contract by the tourist, which will be debited, irrespective of the payment of the deposit, administrative fees and penalties as indicated in the information at the time provided in the technical sheet of the package travel.

In the case of civil disputes relating to the application of this Chapter, the territorial jurisdiction is that of the Court of the place of residence or domicile of the tourist, if located in the territory of the State of Italy.

 

  1. AMENDMENTS AFTER DEPARTURE

If, after departure, the organizer Taste Scenario is unable to provide, for any reason, except that regarding the tourist, an essential part of the services indicated in the contract, the organizer Taste Scenario will have to provide alternative solutions without any price supplement to be paid by the tourist, and if the provided services are of lower value than the ones agreed, the tourist must be refunded the amount corresponding to that difference.

If no alternative solution is possible, i.e. the solution provided by the organizer Taste Scenario is rejected by the tourist for well-justified reasons, the organizer Taste Scenario will provide a means of transport equivalent to the original one agreed for the return to the place of departure of the package travel or to any other place agreed upon, compatible with the availability of means and seats, and will reimburse the tourist to the extent of the difference between the cost of the expected services and the performance of the services actually provided until the time of early return.

 

  1. REPLACEMENT

The tourist who withdraws may be replaced by another person if:

  1. a) the organizer Taste Scenario is informed in writing at least 4 working days before the departure date, being given at the same time notice of the reasons for the substitution and the details of the replacement beneficiary (transferee);
  2. b) the transferee fulfills all the conditions for the use of the service (ex Article 39 Cod. Tur.) and in particular the requirements regarding passport, visas and health certificates;
  3. c) the same services or other alternative services may be provided after replacement: the organizer Taste Scenario will not be responsible for any failure to accept modification by third party service providers. This non-acceptance will be promptly communicated by the organizer Taste Scenario to interested parties before departure.
  4. d) the transferee pays to the organizer Taste Scenario all additional charges, to be quantified before transferring the contract. In the case that the tourist requests a variation of an already-confirmed element of the package, providing that the request does not constitute novation and where it is possible to comply with the request, he/she will also pay to the organizer Taste Scenario a flat rate that will be communicated to him/her. The transferor and the transferee are jointly and severally liable for the payment of the balance of the price as well as of the amounts referred to in point (d) of this Article.

It is understood that, pursuant to art. 944 of the Navigation Code, replacement will be possible only with the carrier’s consent.

Any further modalities and replacement conditions are indicated on the technical sheet.

 

  1. TOURIST OBLIGATION

During the negotiations and in any case before the conclusion of the contract, Italian and non-Italian tourists are provided in writing with general information regarding healthcare obligations and documents required for expatriation. For the rules regarding expatriation of minors, please refer expressly to the State Police website (http://www.poliziadistato.it/articolo/191/).

Foreign citizens can find the corresponding information through their diplomatic representatives in Italy and/or their respective official government information channels. In any case, tourists will be required to check the latest travel advisories with the competent authorities before leaving (for Italian citizens the local Questure or the Ministry of Foreign Affairs via the website www.viaggiaresicuri.it or the Operational Center at +39.06.491115) complying with them before the trip. In the absence of such verification, no liability for the non-departure of one or more tourists may be attributed to the organizer Taste Scenario or to any intermediary.

In any case, any responsibility of the organizer Taste Scenario for any missed departures or trip interruptions due to non-compliance by the tourist with such obligations, as well as irregularities of personal identification documents (passport or identity card) with particular reference to their validity and wear or damage, is excluded.

Tourists must inform the organizer Taste Scenario and any intermediary of their nationality and, at the time of departure, must make sure that they are provided with vaccination certificates, individual passport and any other valid document for all countries included in the itinerary (even in transit), as well as of long-stay or transit visas and health certificates that may be required.

In addition, in order to assess the safety of the social, political, sanitary conditions and to obtain other useful information of the countries of destination and thus the objective usability of the services purchased or to be purchased, the tourist will find official information of a general nature at the Ministry for Foreign Affairs and disseminated through the institutional website of the Farnesina www.viaggiaresicuri.it, which expressly indicates whether destinations are or not formally subject to specific travel alerts or warnings. The above information is not contained in the on-line or printed brochure of tour operators, as they contain general descriptive information as set out in art. 38 of the Tourism Code and does not regard temporary changes. It is the tourist’s responsibility to inform themselves of any changes.

If, at the date of reservation, the chosen destination is found, according to official institutional information channels, not be a recommended place to travel to for security reasons, the traveler who subsequently withdraws will not be able to invoke, for the purpose of exonerating or reducing the claim for compensation for the withdrawal, the failure of the contractual cause relating to the security of the country.

Tourists must also observe the normal rules of caution and the specific rules in force in the countries of destination of the trip, all the information provided to them by the organizer Taste Scenario, as well as the regulations and administrative or legislative provisions relating to the tourist package. Tourists will pay for any damages that the organizer Taste Scenario and/or the intermediary may incur by the failure of the tourist to comply with the above-mentioned obligations, including the expense required for their repatriation.

The tourist is required to provide the organizer Taste Scenario with all the documents, information and elements in his/her possession useful for the exercise of the subrogation rights of the latter against third parties responsible for the damage, and is liable toward the organizer Taste Scenario of the injury caused to the right of subrogation.

The tourist will also communicate in writing to the organizer Taste Scenario, on the proposal of a package travel sale and before sending the booking confirmation of the services by the organizer, any special personal requests that may be the subject of specific agreements on travel arrangements, provided that implementation is possible.

The tourist or any member of the travel group he/she represents is always required to inform the intermediary and the organizer Taste Scenario of any special needs or conditions (pregnancy, food intolerance, disability, etc.) and to explicitly specify the request for related custom services where feasible. This obligation of communication is of particular importance in types of travel which may require an adequate state of psychophysical health, as will be clear from the information and the communicated technical data sheet. The tourist exonerates the organizer from any liability for physical or mental damage, death, or loss or damage incurred by the tourist and resulting from the tourist’s participation in the journey/package travel/excursion, except when such inconvenience or damage is caused by deliberate lack of caution or fraudulent conduct on the part of Taste Scenario.

 

  1. HOTEL CLASSIFICATION

The official classification of hotel facilities is provided on the website or in the brochure or in other information material on the basis of the formal indications of the competent authorities of the country where the service is provided. In the absence of official classifications recognized by the competent Public Authorities of the countries to which the service refers, the organizer Taste Scenario reserves the right to provide a description of the accommodation establishment, so that the tourist can evaluate and subsequently accept it.

 

  1. RESPONSIBILITY REGULATIONS

The organizer Taste Scenario responds to damage caused to the tourist as a result of total or partial failure of the contractually due services, whether they are carried out personally by the organizer or by third party service providers (to whom the organizer may reserve right of action) unless it is proven that the tourist is responsible for the fact (including initiatives taken independently by the tourist during the execution of the tourist services) or due to an unforeseeable or unavoidable fact by third parties, from circumstances beyond the scope of the provision of the services provided for in the contract, by force majeure, by unforeseeable circumstances, or by acts, omissions and circumstances that the organizer Taste Scenario himself could not, according to professional diligence, reasonably control, predict or resolve.

The organizer Taste Scenario pays particular attention to the selection of its suppliers and services which are an integral part of the travel contract. The organizer Taste Scenario declines any responsibility for any excursion and/or activity and/or service that the tourist should purchase from third parties and which is not subject of the contract with the organizer.

An intermediary with whom a reservation of the package travel has been made, is in no way responsible for the obligations arising from the organization of the travel, but is solely responsible for the obligations arising from their being intermediary, in any case, within the limits set forth for such liability under the applicable rules in this matter, except for the exemption provided for in art. 46 of the Tourism Code.

 

  1. COMPENSATION LIMITS

The damages referred to in articles 44, 45 and 47 of the Tourism Code and the relative rules of limitations are governed by the provisions of the Code, and in any case within the established limits, by International Convention on Travel Contracts, by International Conventions which govern the benefits that are the object of the package travel and by articles 1783 and 1784 of the Italian Civil Code, within the limits established by C.C.V.

 

  1. OBLIGATION OF ASSISTANCE

The organizer Taste Scenario must provide the tourist with assistance measures according to due diligence, with exclusive reference to its obligations under law or contract. The organizer Taste Scenario and the intermediary are exonerated from their responsibilities (Articles 15 and 16 of the present General Conditions) when the failure or incorrect execution of the contract is attributable to the tourist or is due to a case of unforeseeable or unavoidable nature, or force majeure.

 

  1. COMPLAINTS

Any failure to execute the contract must be contested by the tourist when using the package travel by promptly submitting a complaint so that the organizer Taste Scenario, its local representative or the tour leader can promptly remedy it. Otherwise compensation will be deducted or excluded pursuant to art. 1227 of the Civil Code. The tourist must also – by default – issue a complaint by sending a registered letter with acknowledgment of receipt or other means of proof of receipt, to the organizer Taste Scenario or to the intermediary, not later than ten working days from the date of return of the tourist to the initial point of departure.

 

  1. MEDICAL, CANCELLATION AND REPATRIATION EXPENSES INSURANCE

If not explicitly included in the price, Taste Scenario recommends that the tourist take out supplementary insurance covering the costs of canceling the travel package or delayed travel, medical expenses, injuries, and/or illnesses, as well as the costs of repatriation and luggage loss and\or damage etc. For those who request it, it is possible to take out a supplementary insurance  when booking the package travel thanks to a service offered by the organizer or in case by the seller. Rights arising from insurance contracts must be exercised by the tourist directly with the Insurance Company, under the terms and conditions stipulated in the insurance policies, as may be reported on the website, brochure or travel programs or information notes published by the organizer Taste Scenario.

 

  1. ALTERNATIVE RESOLUTION INSTRUMENTS

In accordance with and with the effects of art. 67 of Tur. Cod. the organizer Taste Scenario may propose to the tourist – on its own website or in other forms – alternative ways of resolving disputes. In this case, the organizer Taste Scenario will indicate the type of alternative resolution proposed and the effects that this agreement to the proposal entails.

 

  1. GUARANTEE FUND

The package travels sold according to the contract governed by these general conditions, in case of insolvency or bankruptcy of the organizer Taste Scenario, are supported by a guarantee for the repayment of the price paid for the purchase of the package travel and immediate repatriation in the case of travel abroad, in accordance with the provisions of the second paragraph of art. 47 of the Tourism Code.

For this purpose, TASTE SCENARIO BY MERIDIES SNC DI ERICA CROCE AND GIOVANNI PERRI have taken out an appropriate insurance policy (Filo Diretto Protection – 6006002394/C with the company NOBIS – Filo Diretto Assicurazioni (through the intermediary of Borghini e Cossa Srl).

 

  1. CHANGES TO SCHEDULED SERVICES

Taking into consideration that travel plans providing information on how to use the services are published, built and agreed on far in advance, it should be noted that that there may be variations to schedules, flights or other means of transport routes as indicated in the proposal since they are subject to subsequent validation. The tourist must therefore check if the services are confirmed with his/her agency before departure. The organizer Taste Scenario will inform passengers about the identity of any carrier present in the contract in due time and manner.

 

COMPULSORY COMMUNICATION  PURSUANT TO ART. 17 OF LAW NO. 38/2006

Our travel plans are based on exchange rates, timetables, service costs, airport taxes, transportation rates in force at the time of preparation and quotation.

The validity of the programs, rates and the general conditions of sale is related to the period of online publication.
